Protection of the Weaker Party and Consumer in Private Law (ZOSSaSvSPd004)

Course topics: The course focuses on the topics of protection of the weaker party, which are the most discussed in the contemporary scientific literature. Basic thematic areas: - definition of the weaker party, substantive and formal means of protection of the weaker party, - the idea of social justice in private law, - European sources of consumer protection law, - consumer contracts, - cross-cutting and sectoral consumer protection regulations, - basic consumer protection instruments (pre-contractual stage, control of the content of the contract, shift of the burden of proof, right to terminate the contract), - enforcement and enforcement of the right to consumer protection, - alternative dispute resolution and collective redress in consumer protection law, - unfair competition and consumer protection, - Unacceptable contract terms, - unfair commercial practices, - protection of the weaker party in commercial relations, - public consumer remedies, - consumer protection associations, their role, position of perspective and - the case law of the Court of Justice of the EU.
