Practical Classes of Civil Law (YNOPm595)

Course topics: 1. Assignment of a case study of synthetic character - case analysis, differences between ex ante (negotiation) and ex post (elimination of consequences, litigation) approaches, connections between substantive and procedural civil law. 2. Estimation of risks and the process of their elimination, design of the optimal solution for the client, assessment of advantages and disadvantages of the proposed solution, communication with the client. 3. Costs of legal acts, evaluation of a lawyer\'s work, lawyer\'s tariff, reimbursement of costs of proceedings. 4. Elaboration of a related substantive act, e.g. power of attorney, contract, proposal for settlement, pre-litigation summons, offer for sale, etc. 5. Elaboration of related process assignments, e.g. pre - litigation summons, lawsuit, replica, etc. 6. Practical aspects of evidence (means of procedural attack and defence, method of interrogating a witness), elaboration of a related assignment as necessary. 7. Analysis and structure of the sentence, various wording methods, argumentation by court decisions. 8. Attorney\'s ethical dilemmas - solving a selected ethical dilemma. 9. Presentation of the selected problem - focus on language presentation and argumentation skills. 10. Presentation of the selected problem - focus on language presentation and argumentation skills. 11. Judge\'s ethical dilemmas - solving a selected ethical dilemma. 12. Final evaluation and discussion.
