Substantive Civil Law III (XNOPb005)

Course topics: 1. The concept and function of law of obligations, systematics and classification. Relationship in law of obligations and its components. Subjects of relations in law of obligations. Common obligations. 2. Content of relations in law of obligations. Liability for defects. 3. Changes in content and in subjects of relations in law of obligations. 4. Securing liabilities. 5. Termination of obligations by fulfilment. Legal consequences for non-compliance of a debt. 6. Termination of unfulfilled obligations (withdrawal, severance pay, termination, agreement, impossibility of performance, set-off, non-application of the law, settlement). 7. Liability for damage: concept, types, subjects, function. 8. General subject matter of liability: characteristics, assumptions of origin. 9. Special subject matters of liability: characteristics, assumptions of origin. 10. Extent and method of compensation. A shared responsibility. Co-inflicted harm on victims. Responsibility for others and sentencing. 11. Consumer protection in contract law: sources of legislation, general and sectoral consumer protection instruments. Unfair commercial practices. 12. Consumer contracts - general characteristics. Pre-contractual consumer protection instruments. Checking the content of the consumer contract, unacceptable conditions.
