International and European Copyright Law (YNDVm402)

Course topics: International and European copyright law is a legal subject associated with the latest cultural, scientific, technical and international developments and their impact on copyright. The subject is mainly related to intellectual property law, but it is also related to civil law and private international law, but it also has important public law interrelations, especially with regard to international public law and criminal law. It pays special attention to the following basic topics: 1. Comparison of Anglo-American and European legal environments. 2. Relationship between the principle of territoriality and lex loci protectionis. 3. Substantive copyright in the context of the Berne Convention and the WCT. 4. Substantive copyright in the context of the European Copyright Directives. 5. Enforceability of copyright in the context of the Directive on the Enforcement of Intellectual Property Rights and the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). 6. Analysis of selected decisions of the European Commission, the Court of Justice of the EU and the European Court of Human Rights. 7. Collective rights management in the context of the Collective Rights Management Directive. 8. Rights related to copyright in the context of the Rome Convention and the WPPT. 9. Rights related to copyright in the context of European directives. 10. Computer programs and databases in European and international laws. 11. The responsibility of online platforms in the context of the Copyright Directive in the Digital Single Market. 12. The relationship between copyright and private international law.
