Principles of Private Law (ZZSPd006)

Course topics: The course will focus on the principles of private law, in particular on the following topics: - the doctrinal nature and practical significance of the principles of law; - the principles of private law against the background of the distinction between private and public law; - principles of private law and their legal (non-) definition; - conflict of principles of private law; - the principle of autonomy of will in private law; the principles of equality and protection of the weaker party in private law, and - principles specific to each private law subsystem, - European principles of private law. Within these areas, an analysis of doctrinal views, legislation and case law in relation to the specific manifestations of the principles will take place.
