Substantive Civil Law II (XNOPb004)

Course topics: 1. Introduction to rights in rem (relation of absolute and relative rights, concept of relation to things, history, system of rights in rem) and introduction to property rights (interdisciplinary concept, institutes, subject and content). 2. Ownership: restriction and protection of the owner, neighbourhood disputes. 3. Real estate cadastre - nature, types of registrations, proceedings focusing on the creation of rights in rem. 4. Possession and its protection, retention and other methods of acquisition of ownership, transfer and transition of ownership, original and derivative acquisition of ownership. 5. Joint co-ownership. 6. Unshared co-ownership of spouses. 7. Rights in a foreign matter I (lien - substantive issues): general issues, origin, content, performance and termination. 8. Rights in a foreign matter II - encumbrances, including statutory encumbrances. 9. Legal regime of land ownership (purpose determination of land types, soil protection) and legal regime of ownership of buildings (public and private aspect of origin, peculiarities of performance and limitation of ownership rights to them). Especially construction on foreign land, construction from a civil and administrative points of view. 10. Ownership of flats and non-residential premises - acquisition of ownership, administration of a residential / non-residential house. Introduction to the ways of using flats and non-residential premises and dispositions with them. 11. Inheritance law: general issues (subject, scope, sources, principles), protection of heirs, basic procedural aspects. 12. Inheritance law: inheritance by law, inheritance by will.
